KAIA TERMS OF USE

1. INTRODUCTION
These Terms of Use (hereinafter, the "Terms") govern the access, download, installation, and use of the mobile application "Kaia" (hereinafter, "Kaia" or the "Platform").
By registering, accessing, or using Kaia, you (hereinafter, the "User") enter into a legally binding contract and agree to be bound by these Terms in their entirety. If you do not agree with any of the provisions set forth herein, you must refrain from using the application and proceed with its immediate uninstallation.
Kaia is designed and operated in strict compliance with current regulations in Spain and the European Union, including Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD), and Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).
2. DESCRIPTION OF KAIA AND RELATIONSHIP WITH THE ÁGORAS ECOSYSTEM
2.1. Nature of the Platform
Kaia is a polymorphic mobile social network that allows the User to relate, interact, and communicate through different operating modes integrated into a single interface and closed ecosystem.
2.2. Relationship with the Ágoras ecosystem
Kaia is part of the "Ágoras" software ecosystem, the latter being the parent platform. However, for technical, legal, and operational purposes, Kaia is a strictly independent application.
The link between Kaia and Ágoras is exclusively limited to the following underlying infrastructure elements:
- Use of the OAuth protocol via the accounts.agoras.es domain for identity authentication.
- Implementation of the same Zero-Trust security architecture philosophy.
- Use of the same Anti-Jailbreak and Play Integrity verification systems.
- Partial sharing of the artificial intelligence engine intended for content moderation.
2.3. Data segregation and architecture isolation
The User acknowledges and accepts that Kaia operates under an isolated infrastructure. Consequently, Kaia:
- Has an exclusive and independent database.
- Operates on a backend completely separate from the rest of the Ágoras ecosystem.
- Is governed by its own independent Privacy Policy.
- Maintains an autonomous software development and evolution cycle.
It is expressly established that Kaia and Ágoras do not share, cross, or synchronize the following data volume:
- User posts.
- Private communications or direct messages.
- Lists of followers, following, or contact networks.
- User profiles, bios, or customization settings.
Authentication via an Ágoras account in Kaia has the sole purpose of verifying the User's digital identity, without this implying the migration or synchronization of information between platforms.
3. REGISTRATION AND AUTHENTICATION
3.1. Access methods
To use Kaia, the User must create an account or log in through authorized identity providers. Currently, the Platform allows authentication via:
- Native Kaia account.
- Ágoras ecosystem account (via OAuth 2.0).
- Google Sign-In.
- Apple Sign-In.
3.2. Accuracy of information
The User undertakes to provide true, accurate, lawful, and updated information during the registration process. Identity theft or the use of third-party credentials is strictly prohibited and will result in immediate account suspension.
3.3. Responsibility for credentials
The User is solely responsible for maintaining the confidentiality of their access credentials, as well as all activities that occur under their account. Kaia will not assume any responsibility for losses or damages derived from unauthorized access to the User's account as a result of negligence in the custody of their credentials.
4. SECURITY MECHANISMS AND INTEGRITY VERIFICATION
Kaia implements a security architecture based on the Zero-Trust model, assuming by default that the client's execution environment is inherently insecure. To ensure the viability of the ecosystem, prevent fraud, avoid the proliferation of automated accounts (bots), and protect the privacy of other users, Kaia requires the client device to comply with strict cryptographic and software integrity standards.
The Platform natively integrates Anti-Root, Anti-Emulator, and Anti-Tampering systems.
4.1 On iOS devices
To ensure the application runs in a trusted environment, Kaia actively audits the device's operating system for unauthorized modifications or privilege escalation that compromise the system's security model. The User agrees that the application verifies device integrity via system-level calls to detect any manufacturer restriction evasion ("Jailbreak"), as well as dynamic library injection or modifications to Kaia's original binary. Detection of a compromised environment will prevent the application from running.
4.2 On Android devices
Access to Kaia from Android operating systems requires successful and continuous validation via hardware and software attestation services, specifically through Google Play Integrity and Device Integrity APIs. The application will cryptographically verify that the device has not been altered ("Root"), the bootloader remains locked, the execution environment is not an emulator or virtual machine, and the installed application binary matches the officially distributed one. Failure to obtain a valid integrity verdict will result in denial of access to Kaia's servers.
4.3 Acceptance of security measures
The use of Kaia is conditioned upon the explicit acceptance of these security mechanisms. The User understands, acknowledges, and accepts that Kaia will perform periodic background checks while the application is in use to verify the status of device components. Any attempt to evade, patch, modify, reverse engineer, or intercept Kaia's communication protocols or integrity controls constitutes a material breach of these Terms, empowering Kaia to permanently suspend the User's account and deny future access to the platform.
5. PRIVACY POLICY
The processing of the User's personal data is governed by the Kaia Privacy Policy, an independent legal document specific to this application, which the User must read and accept before completing registration.
Said Policy exhaustively details what data is collected, the legitimizing bases for its processing, retention periods, organizational and technical security measures implemented, as well as the ways for the User to exercise their rights of access, rectification, deletion, opposition, limitation, and portability.
6. CONTENT PUBLISHING AND MODERATION
6.1. Content ownership
The User retains at all times the intellectual property rights over any content, text, image, or information they publish, send, or transmit through Kaia (the "User Content").
6.2. License of use
By publishing content on Kaia, the User grants the Platform a global, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, and distribute said content, exclusively for the purpose of operating, developing, providing, and improving the application and its different operating modes. This license ends when the User deletes their content or account (unless the law requires its temporary retention).
6.3. Rules of conduct and prohibitions
The User undertakes not to use Kaia to transmit, publish, or disseminate:
- Illegal, illicit content or content promoting criminal activities.
- Spam, unsolicited commercial content, or fraudulent schemes.
- Hate speech, discrimination, racism, xenophobia, or violence.
- Material constituting harassment, intimidation, doxing, or threats towards other users or third parties.
- Content designed for identity theft (phishing).
- Images or texts infringing third-party intellectual or industrial property rights.
6.4. Platform Moderation
Kaia employs a combination of automated Artificial Intelligence (AI) systems and manual review teams to audit compliance with these rules. The Platform reserves the right, at its sole discretion and without prior notice, to remove, hide, or restrict access to any content that violates these Terms, as well as to report illegal activities to competent authorities.
7. OPERATING MODES
Kaia is a polymorphic social network unifying different dimensions of human interaction. All modes share the same user profile and underlying navigation structure, slightly adapting their interface depending on the context.
7.1. Social Mode (Microblogging)
This mode is designed for public expression and direct debate. The User acknowledges and values the following architectural and philosophical limitations of this mode, which Kaia legally commits to maintain:
- Strictly chronological feed: Posts are shown in temporal order of publication.
- Absence of retention algorithms: Kaia does not use recommendation algorithms to prioritize content, hijack attention, or maximize screen time.
- Absence of psychological and behavioral profiling: The app does not track reading time, scrolling patterns, or past interactions to modify or hide content shown in the feed.
- Absence of interest system: Profiles are not clustered by themes to direct content.
- Format limitations: Post creation is allowed in text format, comments, ratings ("Likes"), with a strict limit of one (1) image per post.
7.2. Dating Mode
The Dating mode is conceived to foster mutual acquaintance among users via a profile and matching system.
By using this mode, the User understands and expressly accepts that Kaia acts as a mere technological intermediary and, therefore, does not guarantee in any case:
- Obtaining matches.
- Responses or initiation of conversations by third parties.
- Real affinity, psychological or emotional compatibility with other users.
- Success in achieving relationships of any kind.
Users are solely and exclusively responsible for interactions, conversations, and decisions made within the Dating mode.
7.3. Specialist Mode
The Specialist mode allows users to showcase their skills, trajectories, portfolios, and professional profiles to the rest of the community.
Kaia merely provides the digital space for exhibiting said profiles. The Platform does not act as an employment agency, employer, recruiter, or guarantor. Kaia does not audit the veracity of published professional credentials and is not responsible, under any circumstance, for the outcome, fulfillment, or execution of professional, contractual, or commercial relationships users decide to establish as a result of their contact in the application.
7.4. Private Messaging
Kaia features direct messaging functionality between users. To ensure security in data transit, messaging communications are carried out via encrypted connections using industry-standard security protocols (TLS).
Important legal note: The User is duly informed that direct messages DO NOT use End-to-End Encryption, thus communications are stored encrypted at rest in Kaia's database to allow cross-platform functionalities and moderation in case of user reports.
8. KAIA INTELLECTUAL AND INDUSTRIAL PROPERTY
All intellectual and industrial property rights over Kaia's software, source code, architecture, design, interfaces, logos, trademarks, validation algorithms, and Artificial Intelligence models (excluding User Content) are the exclusive property of Kaia's creators and the Ágoras ecosystem, or their respective licensors.
Reproduction, distribution, public communication, transformation, reverse engineering, decompilation, or extraction of any part of the application software without prior, express, and written authorization from its owners is strictly prohibited.
9. USER RESPONSIBILITY
The User undertakes to make appropriate, ethical, and legal use of Kaia. The User assumes exclusive responsibility for:
- Any damage, prejudice, claim, or sanction derived from the content they publish.
- Fraudulent, illicit, or abusive use of any of the Platform's modes (Social, Dating, Specialist).
- Consequences of sharing personal, financial, or contact information with other users via the public network or private messaging.
The User shall hold Kaia, its developers, directors, and employees harmless against any third-party claim motivated by the User's breach of these Terms.
10. ACCOUNT SUSPENSION AND TERMINATION
Kaia reserves the unilateral right to temporarily suspend or permanently delete any User's account, as well as to prevent their access to the Platform via device-level or network blocking, without right to compensation or prior notice, when, among others, the following causes occur:
- Detection of Root, Jailbreak, or privilege escalation systems on the User's device.
- Alteration, manipulation, or modification of the official Kaia client (App).
- Any attempt at reverse engineering, decompiling, or cyberattack against Kaia's infrastructure.
- Use, deployment, or integration of unauthorized automations, bots, scrapers, or scripts to extract data or interact with the platform.
- Fraudulent use of the platform to deceive, scam, or harm other users.
- Repeated or severe breach of the content publishing and moderation rules described in section 6.
In case of termination for breach, the User will lose access to all their information, messaging history, and profile, being unable to claim its recovery.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by current legislation, Kaia (including its developers, administrators, and operators) shall not assume any civil, criminal, or administrative liability towards the User or third parties for:
- User Conduct: Offensive, defamatory, illegal, or inappropriate behavior carried out by other users inside or outside the Platform.
- Personal relationships and physical encounters: Any incident, emotional, physical, or material damage resulting from personal relationships or physical encounters originating in the Dating mode, Social mode, or any other section of the application.
- Professional relationships: Non-payments, breaches of contract, negligence, or damages derived from professional services contracted between users after contacting in the Specialist mode.
- False information: Inaccuracy, falsehood, or deception present in user profiles, bios, or posts.
- Technical availability: Interruptions, service outages, temporary data loss, network failures, or software errors resulting from maintenance, distributed denial-of-service (DDoS) attacks, or force majeure.
Kaia is provided "as-is" and "as available", without express or implied warranties of merchantability, fitness for a particular purpose, or technical infallibility.
12. APPLICABLE LAW AND JURISDICTION
These Terms of Use, as well as any dispute, conflict, or claim arising in connection with their interpretation, execution, or validity, shall be governed and interpreted in accordance with the common law of Spain.
For the resolution of any controversy, the parties agree to expressly submit to the competent Courts and Tribunals of the User's domicile, provided they hold the legal status of consumer according to applicable Spanish and European regulations. If the User is not considered a consumer, the parties shall submit to the jurisdiction of the competent Courts and Tribunals according to Spanish procedural law.
